A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On July 9, 2015, the Defendant sentenced 8 months to imprisonment with prison labor for the obstruction of performance of official duties at the Busan District Court on March 6, 2016.

1. On February 24, 2019, the Defendant: (a) around 00:26, the bus stops in front of the Busan Suwon-gu B apartment, Busan, and (b) D buses driven by the victim C (50 years of age) who is a bus engineer, are under the influence of alcohol at the time of stopping at the said bus stops in order to get on and off the bus, and the victim discovered such bus stops the bus above the Defendant; (b) the victim stopped the bus at the front door of the bus; (c) the victim lying from the front door of the said bus to the front door of the bus, saying, “I have difficulty in getting off the bus at the stop,” and said victim takes a heavy bath on the part of the passenger E, and (d) the passenger 10 passengers wished to take a heavy bath on the bus, so that he may not take a bath for about 10 minutes of the bus.

Accordingly, the defendant interfered with the business of bus operation of the victim by force.

2. 공무집행방해 피고인은 2019. 2. 24. 00:35경 전항 기재 장소에서, 피고인이 술에 취하여 소란을 피워 버스가 운행하지 못하도록 하고 있다는 승객 E의 112신고를 받고 출동한 부산 연제경찰서 F파출소 소속 경사 G으로부터 업무방해죄의 현행범인으로 체포당하게 되자 위 G에게 “야 이 개새끼, 짭새들아, 내가 가만히 있을 줄 아나, 씹할 놈들아, 다 죽여버린다”라고 욕설을 하며 양손으로 위 G의 가슴 부위를 2회 밀쳐 폭행하였다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the arrest of a flagrant offender by police officers.
