A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
Around August 2008, the Defendant: (a) prepared an apartment loan of KRW 75 million and KRW 30 million from private financing enterprises to be financed in lots; (b) received apartment bonds for the purpose of investment, and (c) failed to repay the principal and interest of loans; (c) notified that, even if the applicant for the loan does not directly visit, documents, such as a copy of the resident registration certificate necessary for the loan, can be submitted by facsimile and that the loan can be made by mail if the loan is received from private financing enterprises; (d) from June 2008, the Defendant sent a copy of the resident registration certificate and a copy of resident registration certificate of B and his woman residing together with the Defendant, and used them to obtain loans under the name of B and C, and then used them.
1. Crimes by stealing the B name;
A. A. Around July 2009, the Defendant violated the Resident Registration Act: (a) around the end of Gyeonggi-do, the Defendant sent a copy of the victim’s resident registration certificate to the HK Mutual Savings Bank by facsimile in a mutual gate in front of the Defendant’s office at 105 Dong 1502, the Defendant’s office; and (b) by facsimile the copy of the victim’s resident registration certificate to obtain a loan under the victim’s name B
Accordingly, the defendant used the victim B's resident registration certificate unlawfully.
From that time until May 2, 2011, the Defendant used the victim B’s resident registration certificates on 22 occasions in the same manner as the list of crimes (1) in attached Form No. 1.
B. On July 31, 2009, the Defendant forged private documents without authority for the purpose of exercising the right to obtain a loan at the home of the Defendant, 105 Dong 1502, the Defendant entered B’s name, resident registration number, and address in the applicant column in the form of a credit loan application form received in advance from HK Mutual Savings Bank, and entered “5 million won” in the loan amount column and sign “B” in the applicant’s signature column.
