Reasons
Punishment of the crime
[Criminal Power] On July 24, 2007, the Defendant and the candidate for medical treatment and custody (hereinafter “Defendant”) were sentenced to 10 months of imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (a collective act, a deadly weapon, etc.) at the Changwon District Court on July 24, 2007. On October 5, 2007, Ulsan District Court sentenced seven months of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. and completed the execution of the final sentence on September 11, 2008. On October 14, 2011, the Ulsan District Court sentenced ten months of imprisonment with prison labor for a violation of the Act on the Control of Narcotics, etc. (fence) at the Ulsan District Court on October 22, 2011.
【Criminal Facts】
1. Defendant A is not a person handling narcotics, etc.
(1) On June 8, 2011, the Defendant issued a penphone by providing B with one gram of the Mesphere (one philopon; hereinafter referred to as a “philopon”) at the cross-discilized telephone in Seo-gu, Gwangju, Gwangju, for free. (2) On August 7, 2011, the Defendant provided B with one gramlopon by providing B with one gramlopon at the 605 room in Seo-gu, Gwangju, Seo-gu, Seoul, and delivering B with one gramlopon.
3) On August 31, 201, the Defendant: (a) provided B with a total of approximately 1.54g gramphones totaling KRW 1.64g gatephones, which are divided into 0.1g gatephones contained in a disposable injection machine; (b) around 22:00 on October 5, 201, the Defendant provided KRW 0.7g of 1.54g gatephones, which were parked in the middle part of the Gangseo-gu Seoul Metropolitan Government Gluridong-gu, Busan Metropolitan Government, and the Defendant provided KRW 1.5g of 1.54g gatephones in a disposable injection machine. (c) On October 22:00, 201, the Defendant provided the Defendant with approximately 0.07g gramphones on the side of the one-time injection vehicle.
5) At around 22:00 on October 7, 201, the Defendant: (a) provided I with approximately 0.12 gramphones contained in the disposable injection machine located in the front line of the J-gun of Ulsan-gun, Ulsan-gun; (b) on September 16, 2010, the Defendant issued to I approximately 0.12 grams of phiphones contained in the disposable injection machine. (b) On September 16, 201, the Defendant was running by the Defendant in the “Lriju station” operated by the Defendant in the Haan-gun, U.S., Ulsan-gun.
