Punishment of the crime
1. Defluence;
가. 피고인은 2015. 5. 21. 23:28경 서울 강북구 B 지층에 있는 피고인 운영의 CPC방에서 네이버 카페 사이트 ‘D’에 접속하여 제목 ‘E’라고 글을 올렸는데, 해당 글에 댓글을 게시한 피해자 F을 상대로 ‘뭔데 시비 거냐 50대 밖에 안 되는 새끼가 니보다 훨씬 잘된다. 개새끼야 별거지 같은 새끼가 돈도 없는게.. 돈도 못 버는 개새끼야 망해라 병신새끼야. 버러지 같은 새끼가 시비 거네.. 니 애미랑 개새끼야 돈도 없는 개소형 새끼가, 직접 보면 찍소리 못할 새끼가 인터넷이라고 시비 거네 병신새끼가 어딜 가나 너 같은 새끼 꼭 있더라. 꼴에 성당다니냐 예수 좃이나 빨아라 개새끼야 니 애미 예수한테 강간당해라 사생아 새끼야 예수가 개같이 뒤졌듯이 니 애미랑 너도 똑같이 뒤져라.’라고 댓글을 게시하였다.
B. On May 21, 2015, around 23:55, the Defendant posted comments on the title “G” that was connected to the “D” site from the above CPC bank and posted by the victim, to the “G” that was used by the victim.
C. On May 21, 2015, from around 23:55 to May 22, 2015, the Defendant posted a statement stating “I,” “I,” the victim posted by accessing the said CPC to D’s website from the said CPC to “D.”
On May 2, 2015, at around 00:02, the Defendant posted a statement on the part of the Defendant, stating that “I have no falling, but should go back to her,” the part of the Defendant’s “I have access to the “D” site from the above CPC.”
E. On May 22, 2015, the Defendant, at the above CPC bank around 00:02, connected to the “D” site and posted by the victim.
