A defendant shall be punished by imprisonment for three years.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

At around 12:40 on September 17, 201, the Defendant, at the bus stops located in Suwon-si C, sent an opportunity to commit an indecent act against the victim, who was a middle school student E (n, 14 years old) who was returning home after a Saturday at the bus stops located in Suwon-si C, and had talked about 14 years old and that he would buy the victim by advertising the bus at 66, 10, 33 times, and moved to the bus stops in G high school located in the area F of Suwon-si, Suwon-si.

As above, the Defendant moved the victim in front of the hospital building located in Suwon-si H at around 16:38 of the same day on the same day, and, on the ground that the victim’s knee, attempted to fall away, the Defendant: (a) sent the victim “to ree the knee,” and (b) moved the victim into the stairs of the building.

피고인은 위 건물 계단에서 피해자에게 “9월 달이 지나면 생리를 못하고 키가 안자란다, 생리를 하는지 감지를 해봐야겠다”며 겁을 주면서 피해자의 혀를 내밀게 한 다음 피해자의 혀를 피고인의 혀로 핥고, 피해자의 하의를 내려 피해자의 성기 부분을 본 다음 피고인의 하의를 내린 후 자신의 성기를 피해자의 손으로 만지게 하고, 피해자의 흰색 티셔츠를 올리고 손으로 배와 등을 만지며 입으로 피해자의 가슴을 빠는 등 16:38경부터 17:03경까지 사이에 약 20여 분간 피해자를 강제로 추행하였다.
