Punishment of the crime

피고인은 2014. 8. 13. 23:00경 경기 남양주시 B에 있는 ‘C 아파트’ 지하 주차장에서, 피해자 D(44세)이 차량을 역주행하던 피고인에게 경음기를 울렸다는 이유로 다투던 중, 피해자에게 "야 씹할 새끼야! 니가 뭔데 간섭이야! 좆만 한 게 내려 봐! 죽여 버릴 테니까! 한 주먹거리도 안되는 게 내려 이 새끼야!" 라고 욕설을 하고, 차량을 이동하려고 하던 피해자에게 “어디를 도망 가냐 ”고 하면서 손으로 피해자를 붙잡고, 피고인의 머리를 피해자의 얼굴 가까이 들이대며 주먹을 쥐고 때릴 듯이 위협하는 등 폭행하였다.
