A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Road Traffic Act (AFS) by the Defendant is a person engaging in driving a vehicle B Ecoos car.

On August 21, 2013, at around 19:05, the Defendant driven the said Ecccoo vehicle with a blood alcohol concentration of 0.196%, and proceeded at the speed of about 30km from the Cheongcheon-gu, Incheon, Cheongcheon-gu, 58 pyeong-gu, the two-lanes in front of the Cheongcheon-gu, Cheongcheon-gu, Incheon, the two-lanes of the two-lane.

At the same time, since the victim C-owned D body car was stopped due to the smooth flow of traffic, there was a duty of care to safely operate the driver of the vehicle by properly manipulating the steering direction and brake system of the vehicle.

Nevertheless, the Defendant neglected to do so and proceeds as it is, by negligence, received the part on the right part of the above Acoos car in front of the right part of the said Acoos car. The Defendant was behind the left part of the said Ccoos car.

Ultimately, the Defendant did not immediately stop and take necessary measures despite the Defendant’s negligence on the above job so that the amount equivalent to approximately KRW 1,184,616 of the repair cost for the above vehicle for the victim.

2. On August 21, 2013, the Defendant was under the influence of alcohol without a vehicle driver’s license at around 0.19:05, the Defendant driven the said coo vehicle from the Cheongcheon-dong, Cheongcheon-dong, Cheongcheon-dong, Cheongcheon-do, Incheon, to the front route of the 546 Hando-dong, Seo-gu, Incheon, Seo-gu, Incheon, while driving the coo vehicle at around 3.6 km.
