1. Defendant B’s KRW 50,000,000 per annum for the Plaintiff and 5% per annum from November 11, 2015 to October 19, 2016.
Reasons
1. Determination as to the claim against the defendant B
A. The Plaintiff, as the broker assistant of Defendant B, who is a licensed real estate agent, and Nonparty C, the spouse of Defendant B, had the right to enter into a lease agreement with Nonparty 1707 Dong-dong 803 (hereinafter “instant apartment”) and deceiving C as if he were to have the right to enter into the lease agreement with Defendant B, which was owned D, and claiming damages pursuant to Article 15(2) and Article 30 of the Business Affairs of Licensed Real Estate Agents and Report of Real Estate Transactions Act, or Article 756 of the Civil Act, which was paid from October 9, 2015 to November 11, 2015 as the deposit for lease.
(b) Article 208 (3) 3 of the Civil Procedure Act of the applicable provisions of Acts.
2. Determination on the claim against the defendant Korean Licensed Real Estate Agent Association
A. The facts of recognition 1) Defendant B, as a licensed real estate agent, is a licensed real estate agent, who runs an authorized brokerage business under the name of “G real estate” in Bupyeong-gu, Seocheon-gu, Busan, and C, as the spouse of Defendant B, registered as an assistant to the said real estate and actually operated the said real estate. 2) Defendant C, as the owner of the instant apartment, was entitled to represent D even though he did not have been entrusted with the right to enter into the lease agreement by D, and as such, was in possession of the Plaintiff, on October 9, 2015, with respect to the instant apartment on the following grounds: “The lease deposit is KRW 50,00,000,000,000,000,0000,0000,0000,000,0000,0000,000 won, and the special agreement was received from November 11, 2015 to November 11, 2017,05.
3) The Plaintiff filed a complaint with C with the same content as above 2, and C, even though it did not have been delegated with the authority to conclude a lease contract, acquired 50,000,000 won as the deposit for lease as prescribed in the above 2.
