피고인은 2013. 8. 13. 01:05경 경기 부천시 소사구 심곡본동 312 부천남부역 광장에서 팬티만 입고 싸움을 하고 있다는 취지의 신고를 받고 출동한 경기 부천소사경찰서 B지구대 소속 경사 C이 피고인을 제지한다는 이유로 "나 노숙자야 개새끼야, 야 씨발놈아 니가 뭔데 지랄이야, 니가 옷을 사줘봤냐 왜 입으라 마라야 개새끼야"라고 욕설을 하면서 오른발로 C의 왼발을 걷어차려 하고 오른손으로 C의 왼팔을 잡아 비트는 등 폭행하였다.
