1. Defendant among the distribution schedule prepared on December 19, 2017 by the said court with respect to the F real estate auction case in the Incheon District Court.
Reasons
1. Basic facts
A. On June 3, 2013, the Plaintiff was established with a deposit money of KRW 318,00,000 for the real estate listed in paragraph (1) of the attached Table No. G (hereinafter “instant land”) and the real estate listed in paragraph (2) of the attached Table No. 2 (hereinafter “instant building”) and the 2nd and 5nd floor from G, and the lease on a deposit basis, which is the Plaintiff having chonsegwon.
(The key money for lease on a deposit basis was changed to KRW 348,00,000 on February 17, 2014, and changed to KRW 318,000 on May 29, 2015. (B)
(1) Defendant B’s lease 1) concluded a lease agreement with G on August 9, 2016 under which the term of the lease deposit of KRW 30,000,000 and the term of the lease from August 9, 2016 to August 8, 2018 (hereinafter “instant first lease agreement”).
(2) On August 9, 2016, Defendant B entered into a lease contract (hereinafter “instant lease contract”) with the term of lease deposit amounting to KRW 25,000,000, and the term of lease from March 9, 2015, Defendant C entered into a lease contract with the term of lease from G to March 9, 2017 (hereinafter “instant lease contract”).
Defendant C completed the resident registration transfer report on August 25, 2016 to the building I, and obtained a fixed date in the lease agreement on the same day.
3) On June 8, 2016, Defendant D agreed to lease the instant building J from G with a lease deposit of KRW 25,000,000 and the lease term of KRW 24 months from June 8, 2016 (hereinafter “instant third lease contract”).
Defendant D entered into a contract. Defendant D’s completion of the resident registration transfer report on June 8, 2016, and obtained the fixed date on the same day lease agreement (hereinafter “the same date”). Defendant E from G on May 22, 2014, set the lease deposit amount of KRW 27,00,000 from G, and the lease term of KRW 23,50 from May 23, 2014 to May 23, 2016.
