Defendants shall be punished by imprisonment for ten months.

However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

[criminal records] In the Jeonju District Court on July 23, 2015, Defendant A was sentenced to one year of imprisonment due to a crime of fraud, etc. and the judgment became final and conclusive on March 24, 2016. Defendant B was sentenced to ten months of imprisonment due to a crime of fraud, and the judgment became final and conclusive on January 6, 2016.

[2] After registering a business entity with the purpose of establishing signboards and lighting, the Defendants and D had the business entity registered with the lending company in the name of the nominal owner, recruited the loan owner, set up signboards and lighting at the place of business in which the nominal owner of the loan owner is required, and then submitted construction contracts, quotations, etc. in which the person in the name of the lending company actually engaged in business at the place of business, and made it difficult for the lender to do so, and submitted them to the lending agency through display. The Defendants and D had the business entity registered in the name of “E” for the purpose of using the disguised construction work for the establishment of the said place of business as the loan owner, in which the lending company is believed to have been able to pay monthly installments, while operating the said place of business at the above place of business.

On the Internet around October 2014, Defendant A, who committed a joint crime with F under the name of the lending title, puts down on the Internet a letter “to contact liquor tax on persons in need of cash, and to contact with the head of G office H,” and reported to the F, who installed lighting at the above workplace and unfolded the construction cost and received loans from the lending institution under the name of the construction cost, one of them.

D. The Defendants agreed to the construction cost of KRW 9,80,000,000 and the principal and interest of the loan are KRW 408,333,00 each month when they registered as business operator in F’s name on October 7, 2014. The Defendants and D had a disguised office in the second floor of J building in Seoul Jung-gu, Seoul, and installed a lighting near approximately two million, actual installation cost around October 14, 2014.
