A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall deliver, sell, forge, imitate, or possess a trademark identical with or similar to another person's registered trademark for the purpose of using or making another person use such trademark on goods identical with or similar to the designated goods.

Nevertheless, the Defendant:

1. From September 19, 2017: (a) around 01:50 on September 19, 2017, each trademark holder’s trademark right holder’s trademark right is infringed by holding 10 clothing totaling KRW 4.440,00,00, total market value of the refined goods, which are identical or similar to the trademark owner’s “BURBERY” (registration No. 0497230) without legitimate authority, in the “E store,” the registered trademark owner’s “BURRY” (registration No. 0497230), which is the trademark owner’s trademark at the “E store,” without legitimate authority, for the purpose of selling 10 clothes totaling KRW 4.44,00,00, as shown in

On October 30, 2017, around 23:30 around 23:30: (a) without legitimate authority at the place indicated in paragraph 1, each trademark holder’s trademark right holder’s trademark right is infringed upon by possessing for sale a total of 11 clothes and miscellaneouss, as shown in attached Table 2, with a trademark identical with or similar to the registration of the trademark of “Sene other than Beneseme E. L. L.” (registration No. 40071015300), which is a trademark of “Ieme,” and without legitimate authority; (b) each trademark holder’s trademark right holder’s trademark right;

3. 2017.10. 31. 01:00 경 서울 중구 D 시장 7 층 20, 21호 보관 창고에서 정당한 권한 없이 상표권자 ‘ 샤넬’ 의 등록 상표인 ‘ 샤넬’ 상표( 등록번호 제 4003048000000호) 와 동일하거나 유사한 상표를 부착한 의류 30개, 신발 5개, 단추 봉지 2개를 비롯하여, 별지 범죄 일람표 3 기 재와 같이 의류, 잡화 총 233개를 판매목적으로 소지하여 각 상표권 자들의 상표권을 침해하였다.

As a result, the defendant possessed 254 clothes and miscellaneous goods attached with a trademark identical or similar to the registered trademark of another person for the purpose of sale, and infringed the trademark rights of each trademark holder.
