A A A shall be punished by a fine of 1,000,000 won, by a fine of 5,000,000 won, and by imprisonment of 10 months.

Punishment of the crime

1. The Defendants’ joint crimes committed by the Defendants are the captain of the E-fishing vessel E (a approximately 2.25 tons, approximately 255 E, FRP) without permission, and the Defendants B and C are the diving part of the above E.

No one shall capture, gather or cultivate marine animals and plants by means of fisheries other than those under the Act on Fisheries or the Management of Fishery Resources.

Nevertheless, from around 13:30 on October 22, 2015 to around 15:30, Defendant A moved Defendant B and Defendant C to the place where Defendant B would collect kids from the above E using scoo equipment, etc., which includes the mountain flow prohibited from diving fishing, etc. at the above place, and collected 160 mucks in the sea by using scoober equipment from the sea.

As a result, Defendants conspired to capture and gather marine animals and plants by fishing methods other than those under the Fisheries Act or the Fishery Resources Management Act.

2. Defendant C

A. During the process of diving fishery without permission, the Defendant, who was engaged in diving fishery by using mountain communication, was under control at the site and was examined by the Defendant. As such, the Defendant was aware of the fact that he was under suspension of the execution and would be subject to severe punishment due to a large number of criminal records of the same kind, resulting in the Defendant’s signature in the Defendant’s newspaper protocol.

On October 22, 2015, at around 20:40, the Defendant: (a) maintained deep sea fishery management near the 0.7 nautical miles south-gun of Chungcheongnam-gun, Chungcheongnam-do; (b) the fishery officer affiliated with the above west Sea Fishery Management Group H described the Defendant as “F” in the Defendant’s statement column in the Defendant’s newspaper protocol that he investigated and prepared the Defendant; and (c) indicated the Defendant’s name as “F” in the name of the Defendant.

The defendant is entitled to exercise.
