Defendant shall be punished by a fine of KRW 2,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

A defendant is a livestock farmer who raises cattle. A person who raises livestock shall not ensure that livestock excreta not properly disposed of flows into public waters.

From the beginning of 2012 to October 24, 2012, the Defendant introduced livestock excreta discharged out of a facility from a small breeding facility of approximately 300 square meters in an area that did not report on the installation of a livestock excreta waste-generating facility in Baju City through drainage channels to neighboring farming waterways, which are public waters.

The reason for sentencing under Articles 70 and 69(2) of the Criminal Act is that the Defendant, without reporting on the installation of livestock excreta discharge facilities, has introduced livestock excreta not disposed of properly into public waters without reporting the installation of livestock excreta discharge facilities, and the Defendant repeated the crime of this case even though having been punished by a fine for the same kind of crime in the past. However, the Defendant’s mistake is divided and reflected, and the Defendant has no criminal record for not less than eight times a fine, and the Defendant appears to have collected livestock excreta accumulated superiorly at a certain time to prevent livestock excreta from flowing into agricultural waterways through drainage (However, it appears that the livestock excreta discharged as piping has not been accumulated at a certain time in order to keep the livestock excreta flowing into excellent time from flowing through drainage, such as long as the period of the disposal thereof passes or coming from rain, and it appears that the volume of livestock excreta discharged during the above period is at least one thousand cubic meters, and that the Defendant suffers from health of the aged at least 70 years old.
