A defendant shall be punished by imprisonment for not less than five months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 재물손괴 피고인은 2020. 3. 18. 12:30경 부산 금정구 B에 있는 피해자 C이 운영하는 ‘D약국’에서, 피해자에게 처방전을 보여 주었으나 피해자가 글씨가 잘 보이지 않아 피고인에게 다시 이름을 물어본다는 이유로 “눈까리가 삣냐, 내가 어찌 아노, 씨발년”, "왜 빨리 약을 안주냐"며 욕설을 하면서 그곳 판매대 위에 놓여 있던 컴퓨터 모니터, 프린터, 포스단말기, 도자기 꽃병 등을 양손으로 밀쳐서 떨어뜨려 그 중 피해자 소유인 시가 1만 원 상당의 도자기 꽃병 1개를 깨뜨려 손괴하였다.

2. The Defendant interfered with the business of the victim’s pharmacy operation by force for about 15 minutes, such as: (a) the victim’s act was committed by cutting off the above apparatus and goods on the sales stand of the said pharmacy by hand; (b) the victim’s act was committed by cutting off the left buckbucks on the left side of the victim; and (c) the victim’s act continued to go to a large interest.

3. 공무집행방해 피고인은 2020. 3. 18. 12:50경 제1항 기재 장소에서 112신고를 받고 출동한 부산금정경찰서 E지구대 소속 경위 F에게 재물손괴 및 업무방해 등 혐의로 현행범인 체포당하자 주먹으로 F의 안면부를 1회 때리고 발로 F의 왼쪽 허벅지 부위를 1회 찼다.

Accordingly, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reports.
