Reasons

According to the purport of Gap evidence Nos. 1, 2, and 4 as a whole and all pleadings, the plaintiff was employed as a defendant's employee from January 14, 2015 to receive the payment of KRW 3.5 million monthly, and was notified of dismissal from the defendant on May 31, 2017. The plaintiff filed a petition for adjudication on remedy by asserting that the above dismissal is unfair, and was decided by the National Labor Relations Commission on February 5, 2018. Accordingly, the defendant filed a lawsuit for cancellation of the adjudication on the remedy of unfair dismissal under the Seoul Administrative Court 2018Guhap58356, but it was recognized that the defendant lost the plaintiff on June 13, 2019. The defendant did not dispute the fact that the plaintiff was dismissed and that the plaintiff was not reinstated by the date of the closing of argument in this case.
