1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Each real estate listed in the attached list of the plaintiff's assertion was purchased by both the plaintiff and C with whom they were married, and the registration of ownership transfer was completed in the name of the defendant, who is a punishment of C, due to the relationship between the plaintiff
This is a so-called three-party title trust relationship.
At present, the plaintiff is pending in a divorce lawsuit with C. Since the plaintiff has the right to claim the transfer registration of ownership against each seller as a truster for each of the instant real estate, this right has been claimed in this case by exercising the right to claim the transfer registration of ownership against each seller as a preserved bond.
2. The Plaintiff’s assertion that each of the real estate listed in the separate sheet, the ownership transfer registration of which was completed in the name of the Defendant was purchased by the Plaintiff and C, and that it was merely a title trust in the Defendant’s name, is not sufficient to acknowledge the Plaintiff’s assertion, and there is no other evidence to prove otherwise.
Therefore, the plaintiff's assertion is without merit to examine the remainder of the issue.
3. The plaintiff's claim for conclusion is dismissed as there is no reasonable ground.
