1. The Defendant (Counterclaim Plaintiff) paid KRW 46,476,066 to the Plaintiff (Counterclaim Defendant) and its amount from January 5, 2019 to May 31, 2019.

1. Facts of recognition;

A. The Plaintiff and the Defendant are corporations that engage in the manufacture, sale, etc. of cosmetics.

B. From December 26, 2012, the Plaintiff maintained the transaction relationship with the Defendant. The main contents of the transaction were to obtain salt maleing agents produced by the Defendant (i.e., chloaking agents) using them in mass containers and supply them to the Plaintiff by filling and packing them on individual maleing containers, etc.

C. On April 19, 2018, the Plaintiff received a request from the Defendant for filling and packing salt 2 (Cchchlograph 2) manufactured by the Defendant (Cchlograph 2) from the Defendant; around June 14, 2018, the Plaintiff was provided with salt 2 contained in mass containers from the Defendant; and supplied them to the Defendant after completing the process of filling and packing them on individual softs around June 20, 2018.

(hereinafter referred to as “the salt cap in this case.” Accordingly, the price that the Defendant is obliged to pay is KRW 17,567,360 for the production of finished products, KRW 2,200,00 for development expenses, KRW 6,435,00 for material demand expenses, and KRW 26,202,360 for material demand expenses.

In addition, the Plaintiff received an order from the Defendant for charging and packing Class 2 for Mascact 2 manufactured by the Defendant and delivered the Defendant on August 31, 2018 after completing the work.

Accordingly, the processing cost to be paid by the defendant is KRW 29,383,585.

E. On July 31, 2018, the Defendant paid only KRW 2,200,00 development cost, KRW 6,435,000, total of KRW 8,635,00, and KRW 17,567,360, out of the total processing cost of the instant salt hair, and did not pay the remainder of KRW 17,567,360. The Defendant paid only KRW 474,879, and did not pay the remainder of KRW 28,908,706.

According to the above facts finding as to the claim of the principal lawsuit, the defendant is the day following the delivery of a copy of the complaint of this case to the plaintiff, which is the total of KRW 17,567,360, and the total of KRW 28,908,70, and the total of KRW 46,476,06, and the total of KRW 46,06.
