The sentence of sentence against the defendant shall be suspended.
Reasons
Punishment of the crime
1. When the operating expenses and personnel expenses of the Child Center was insufficient while the Defendant was operating the Child Center in D local areas, the Defendant was willing to pay 600,000 won to the above Child Center’s living welfare workers as monthly salary, but was willing to receive false benefits as if he were to pay 1.1 million or 1.50,000 won to the Victim’s Military Viewing Service, and was willing to receive the difference.
On January 20, 2014, the Defendant submitted an application for a false subsidy (or subsidy) to the effect that “The Defendant would grant 110,000 won to the Gun Child E and F as monthly salary,” respectively, to the person in charge of the Gun Child Viewing and office of the Gun Child Viewing and Do, Si, Gun, Si, Si, Gun.”
Defendant: (a) deceiving a person in charge as above and granted KRW 2,20,000 to the above E and F as a subsidy on the 23th day of the same month; (b) paid KRW 1,200,000 in total as salary; and (c) acquired pecuniary gain equivalent to KRW 1,00,000,000, which is the difference, from around that time to February 5, 2015; and (d) acquired pecuniary gain equivalent to KRW 14,30,000 in total in the same way as the previous list of crimes (1) in the same manner as the previous list of crimes.
2. Embezzlement;
A. A. Around January 23, 2014, the Defendant received and kept KRW 790,50,500 of the project cost for a program, which was specified as a program tuition fee for the Child Center from the victim military viewing by the Defendant’s military service, and used the Defendant’s child as if the Defendant’s child were treated as having paid KRW 51,90 as the program tuition fee, and embezzled by using it as a general operating fee for the welfare center outside of its usage, etc., and used KRW 6,949,150 in total over 13 times from that time to January 27, 2015, as shown in the list of crimes in the attached Table (2).
Accordingly, the defendant embezzled the victim's property.
B. The Defendant is the victim of embezzlement of Saturdays operating expenses on January 26, 2014.
