1. The Defendant’s KRW 117,259,245 to the Plaintiff and 6% per annum from February 12, 2016 to September 14, 2017.
Reasons
1. Determination as to the cause of claim
A. Plaintiff’s assertion 1) On April 9, 2015, the Plaintiff entered into a contract for new construction of housing B with the Defendant and Jeju-si, and set the construction cost at KRW 160 million. After which, at the Defendant’s request during the process of new construction of housing, the contract for new construction of housing was concluded verbally at the Defendant’s request, and the construction cost was set at KRW 160 million, as in the new construction of housing (the sum of the contract for new construction of housing and the contract for new construction of housing, the sum of the contract for new construction of housing and the contract for new construction of housing is referred to as “instant contract

3) However, since the construction cost of KRW 100 million paid by the Defendant to the Plaintiff and KRW 39,859,589,589 shall be deducted, the Defendant is obligated to pay the Plaintiff the construction cost of KRW 238,168,611 (total construction cost of KRW 378,028,200, KRW 1000, KRW 39,859,589), and damages for delay thereof. (B) Determination 1) The Plaintiff and the Defendant set the construction cost of the gold contract of this case as KRW 160,000,000 for new housing construction cost of KRW 160,00 is not disputed between the parties.
On the other hand, the defendant set the amount of 110 million won for the new construction of the string house.
