Criminal facts

Defendant

A reported general restaurant business in the name of "G" in Jeonju-si F and 202, Jeonju-si, and Defendant B registered the performance hall with the trade name of "H performance hall" as "H performance hall."

A person who mainly prepares and sells alcoholic beverages and intends to engage in entertainment bar business in which dancing is permitted for customers shall obtain permission from the competent authorities.

Nevertheless, around September 2012, Defendant A reported the business of the above No. 202 as a general restaurant, and prepared and sold alcoholic beverages and alcoholic beverages. Defendant B registered the above No. 201 as a performance hall, installed stage and lighting facilities, and conspired to allow customers visiting the place to drink and dance alcohol.

위와 같은 공모에 따라 2012. 9. 20. 피고인들은 전주시 완산구 I에 있는 J공인중개사에서 위 201, 202호에 대한 임대차계약을 함께 체결하고, 인테리어 공사도 함께 진행하면서 202호에는 룸 3개와 홀에 테이블 65개, 의자 260석, 레이저조명, 프로젝터 등을 설치하고 201호에는 무대 및 스피커 등 각종 음향장치와 조명시설 등을 설치하였으며, 위 201, 202호 사이의 경계벽을 통유리로 설치하여 서로 훤히 보이도록 하였다.
