Reasons
1. Basic facts
A. On August 30, 201, the Defendant amended the Regulations on the Remuneration of Teachers and Staff and the annual salary contract system for teachers, thereby establishing a new provision on the remuneration of teachers and the annual salary system for teachers applied to the same teachers as the Plaintiffs. From March 3, 2013, the Defendant calculated and paid the remuneration for teachers in accordance with the Regulations on the Remuneration of Teachers and the annual salary system for teachers established from March 2013.
Article 3 (Definition of Terms) The definitions of terms used in this Article shall be as follows:
1. The term “repair” means the aggregated amount of salary and various other allowances;
2. The term "salary" means a basic salary paid by class;
3. The term "Allowance" means an additional allowance paid according to the conditions of duties;
4. The term “grades” means granting a higher rank than the present one after the lapse of a specified tenure of office or under the provisions of other Acts and subordinate statutes.
Article 6 (Assignment to Class) (1) Period required for a promotion in class of teachers shall be two years.
Article 14 (Payment of Allowances) (1) A teacher may be paid necessary allowances in addition to his/her salary within budgetary limits.
Provided, That bonus allowances and household support expenses shall be governed by the provisions of the annual salary contract for teachers.
(2) Types, scope of payment, amount of payment, and other matters necessary for the payment of allowances to be paid under paragraph (1) shall be prescribed separately by rule, subject to resolution by the board of directors.
The main contents of the Regulations on Remuneration of Teachers related to the instant case are as follows:
Article 6 (Remuneration) (1) Remuneration shall be classified into salary and allowances.
(2) A salary shall be determined in accordance with the Regulations on Remuneration of Teachers, and it shall be appraised in accordance with the "Regulations on Evaluation of Teachers' Performance", and shall be paid according to the grades determined according to the standards under paragraph (4).
(3) The allowances shall be determined in accordance with the school personnel allowance rules.
Provided, That bonus allowances and household support expenses shall be assessed in accordance with the "Regulations for Evaluation of Teachers' Performance" and shall be paid according to the grades determined by the standards under paragraph (4).
