Punishment of the crime

1. From August 23, 2005, Defendant A is a person who holds office as the president of M University from August 23, 2005 to now, and has overall control over the operation of the above school and the execution of school expenses.

A violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Misappropriation of trust) is the president of the above university, and the defendant has a duty to implement an appropriate amount through appropriate procedures according to the needs of school operation for N., a victim foundation which owns the above school (the conversion into M., 31 October 2009) in implementing school expenses.

Since the birth B of the president of the corporation, the Defendant continuously purchased a commercial building P 4 dong (2-5 stories) from a school at a higher price than the appropriate price after the construction in 2002.

Around December 29, 2008, the Defendant entered into a sales contract with Q in Mapo-gu, Seoul, to purchase 4 billion won (value-added tax of KRW 150 billion) for the purpose of training facilities for students and teaching staff members, and then, to transfer the total of KRW 4 billion in the name of the National Bank in the above name of the National Bank in the name of B as a down payment date on the same day, from O of the president of the above school juristic person, and from 4, 202, 301, 302, 302, 301, 401, 402, 501, 502, 502) and housing site shares from Ma University, the Defendant transferred the total of KRW 2 billion in the name of the National Bank on the same day as the down payment date.

Accordingly, the defendant is the president of MM University.
