1. For D Co., Ltd:
A. Defendant B shall have jurisdiction over the real estate listed in paragraph 1 of the attached list.
Reasons
1. Judgment on deemed confessions as to Defendant B (Article 208 (3) 2 of the Civil Procedure Act)
2. Judgment by public notice on the claim against Defendant C (Article 208 (3) 3 of the Civil Procedure Act)
3. Claim against the Defendant Gyeonggi Savings Bank Co., Ltd.
A. Facts of recognition 1) D Co., Ltd. (former Trade Name is Co., Ltd. E; hereinafter “E”).
A) From July 200, from around 12, 200, a construction project was implemented to create 7 bonds on the land of 12 lots, including Dongbcheon-si F, etc., and real estate listed in attached Table 1 (hereinafter “instant land”).
(2) On the ground, the real estate indicated in Paragraph (2) of the same Table (hereinafter “instant building”) is the “each of the instant real estate” and combined with the instant land.
2) On March 19, 2001, E completed the registration of ownership transfer based on the sale of the instant land to Defendant B, and completed the registration of ownership transfer based on the sale of the instant building on the same day after completing the registration of ownership transfer on June 25, 2001 to Defendant C on the same day.
3) Defendant Gyeonggi Savings Bank Co., Ltd. (former Trade Name was Gyeonggi Co., Ltd.); on March 19, 2002, it was changed to Gyeonggi Mutual Savings Bank Co., Ltd. and as of September 23, 2010; hereinafter “Defendant Bank”).
(2) On June 5, 2001 and June 25, 2001, each of the instant real estate was loaned KRW 250,000,000 to Green Loans Co., Ltd. as collateral. On June 5, 2001, as to the instant land, the registration of establishment of each of the instant buildings was completed on June 4, 2001 by the Jung-gu District Court No. 6122, Dongducheoncheon Registry, which was received on June 4, 2001; on June 25, 2001, No. 6979,690, which was received on June 25, 2001; on the other hand, on the instant land, by the application of the National Bank, which was a mortgagee, on February 26, 2001 (Seoul District Court subsidies G, and on March 2, 201, the registration of the commencement of auction on October 9, 201).
