All appeals are dismissed.
The costs of appeal are assessed against the plaintiff (Counterclaim defendant) by aggregating the principal lawsuit and counterclaim.
Reasons
The grounds of appeal are examined.
Based on the circumstances indicated in its reasoning, the lower court determined that the Plaintiff (Counterclaim Defendant) was negligent in failing to perform the best duty of care in the course of booming the emulgion between the commander and the womb while performing the emulgion surgery, and that the Defendant (Counterclaim Plaintiff) B did not perform the duty of explanation before performing the surgery.
Examining the relevant legal principles and records, the lower court did not err in its judgment by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal principles on duty of care, duty of explanation, and medical negligence, thereby adversely affecting the conclusion of the judgment.
Therefore, all appeals are dismissed, and the costs of appeal are assessed against the losing party by combining the principal lawsuit and counterclaim. It is so decided as per Disposition by the assent of all participating Justices on the bench.
