A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
From January 10, 2014, the Defendant actually operates “C”, which is a mobile phone sales and repair business entity in Jinju-si B.
1. The Defendant in violation of the Personal Information Protection Act is a personal information manager who collects personal information, such as the name and telephone number of the customers of the said company, and arranges it to an X-gu program.
A personal information manager shall not use the collected personal information for any purpose other than its original purpose, unless he/she obtains separate consent from the data subject.
Nevertheless, the Defendant prepared a “face statement of customer counseling” containing personal information (name, date of birth, and cell phone number) against the said company’s customers, or prepared a “written application for repair” containing personal information (personal information) against the clients who requested repair of a mobile phone, and used the personal information acquired to enter a portal site D as a “real-name member” or “non-real-name member” on the portal site, and expressed an intent to online advertisement of the mobile phone sales store and ice ice cream installation business operated by the Defendant.
On November 5, 2018, the Defendant: (a) opened an account (F) with personal information (name, date of birth, cell phone number) on the customer counseling statement prepared against E; (b) and (c) without obtaining the consent of E using a mobile phone terminal from E; and (d) created a total of 236 accounts with personal information from around that time to March 5, 2019 using personal information of 204 members under the same method, such as the list of crimes (1) and (2).
As a personal information manager, the defendant used personal information for a purpose other than the original purpose without consent of the subject.
2. Any person who violates the Information and Communications Network Act and interferes with business affairs, such as computer trouble, shall be allowed without access authority;
