A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

No person shall flee or conceal his whereabouts for the purpose of evading military service or having military service reduced or exempted, and the accused is a person subject to call-up to public duty personnel service.

Nevertheless, from February 4, 2013, the Defendant was missing for the purpose of evading military service.

As to the facts constituting the crime of this case, even though the defendant had been subject to punishment twice for the same kind of crime under Article 86 of the relevant Act, he/she committed the crime of this case, and until now, his/her location cannot be ascertained, taking into account the defendant's age, sex, environment, motive and circumstances leading to the crime of this case, and circumstances after the crime, etc., the punishment as ordered shall be determined.
