1. The Defendant (Counterclaim Plaintiff) paid KRW 28,265,400 to the Plaintiff (Counterclaim Defendant) and its related amount from October 30, 2018 to December 4, 2018.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On June 9, 2015, the Plaintiff and the Defendant concluded a contract for construction works (hereinafter “instant contract”) with respect to D and two parcels of land (hereinafter “instant construction works”), setting the construction cost of KRW 110,000,000, and the construction period from June 15, 2015 to December 5, 2015.

B. After completing the instant construction work, the Defendant received the completion inspection from the Tong-si on December 3, 2015.

C. The Plaintiff paid KRW 80,000,000, out of the construction cost of KRW 110,000 according to the instant contract, to the Defendant; on April 20, 2016, the Plaintiff prepared a written statement of performance of the construction cost that “the remaining construction cost of KRW 30,000,000 shall be paid by July 31, 2016,” and issued it to the Defendant.

2. Determination on the main claim

A. Since there was a defect such as modification of a stone shed, etc. in relation to the instant construction project, the Defendant is obligated to pay 35,189,150 won and damages for delay to the Plaintiff in lieu of defect repair.
