A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On January 24, 2014, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Regulation of Conducting Fund-Raising Business without Permission at the Seoul Central District Court for the same year.

2.4. A person for whom the above judgment has become final and conclusive.

1. Any person who violates the Act on the Regulation of Conducting Fund-Raising Business without obtaining authorization, permission, registration, etc. under other Acts and subordinate statutes shall be prohibited from engaging in the business of raising funds with the agreement to pay the total amount of investment or an amount in excess thereof to many and unspecified persons;

The Defendant, in collusion with C, D, E, F, G, etc., intended to invite investment funds necessary to operate gambling sites by setting up a server in China from many unspecified persons with the trade name of H, and agreed to receive the total amount of investment funds from the victim K and other unspecified persons, including the victim K, from August 29, 2012 to October 18, 2012, from August 29, 2012, the 4th floor office of the Gangnam-gu Seoul International Building and the Jtel 614 office, etc. of the Gyeonggi-gu Seoul Metropolitan City, Jtel 614, etc., to operate gambling sites. The Defendant, in collusion with C, D, E, F, and H, agreed to receive the total amount of investment funds exceeding 140% including the investment principal, from August 29, 2012 to October 18, 2010, and agreed to receive the amount exceeding 10% of the total amount of investment funds from the victim K from 00,010.

2. The Defendant’s fraud did not take over the said corporation’s capital even if he/she received the investment money from investors, such as the victim K, for the business of operating the gambling site, and there was no fact that he/she did not run a profit-making business.
