1. The plaintiff's lawsuit against the defendant B shall be dismissed.

2. Defendant C shall pay to the Plaintiff KRW 390,000,000 and its amount on July 4, 2009.

1. Facts of recognition;

가. 원고는 2008. 4. 10. D로부터 청주시 흥덕구 E 대 332.9m ^{2}(이하 ‘이 사건 토지’라 한다)를 매수하고, 그 지상에 건물을 신축하던 중 2008. 9. 30. 피고 B에게 이 사건 토지 및 신축중인 지상 건물을 매도(이하 ‘이 사건 매매계약’이라 한다)하였으며, 피고 B은 2008. 9. 30. 2,000만 원, 2008. 10. 1. 1억 3,000만 원, 2009. 1. 1. 1억 6,000만 원 합계 3억 1,000만 원을 원고에게 매매대금으로 지급하였고, 이 사건 매매계약서 중 이 사건과 관련된 내용은 아래와 같다.

B. On October 1, 2008, the Plaintiff reported the change of construction participants to Defendant B as to the above building, and Defendant B obtained approval for the use of the building as to the building completed on October 24, 2008 (hereinafter “the instant building,” including the instant land and the instant building, and completed registration for the preservation of ownership on November 4, 2008. As to the instant land, registration for the transfer of ownership was completed from D’s name on July 3, 2009 to Defendant B.
