1. The Defendant shall pay to the Plaintiff KRW 37,760,193 and the interest rate of KRW 15% per annum from July 19, 2017 to the day of complete payment.

1. Indication of claim;

A. On January 2016, upon receipt of a request from the Defendant to lend KRW 14,00,000 from the Defendant, the Plaintiff wired KRW 10,000 to the Defendant around January 2016, and paid KRW 4,00,000 to the Defendant for the card price used by the Defendant.

B. Since then, the Plaintiff borrowed the Plaintiff’s modern card, national card, and us’s card under the Plaintiff’s name upon the Defendant’s request that the payment be made if the card was lent by the Defendant. However, the Defendant’s failure to use and pay the said card under the Plaintiff’s name is KRW 23,760,193, May 4, 2016.

C. Therefore, the Defendant is obligated to pay to the Plaintiff KRW 37,760,193 (=10,000,000 KRW 4,760,000,000) and damages for delay at the rate of 15% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from July 19, 2017 to the date of full payment, which is the day following the day of the instant judgment that the Plaintiff seeks.
