1. The Plaintiff:
A. Defendant B: (a) on May 23, 2018, the Suwon District Court’s Suwon District Court’s registry office as to the real estate stated in the attached list.
Reasons
1. Facts of recognition;
A. The Plaintiff is the owner of the real estate indicated in the separate sheet (hereinafter “instant real estate”).
B. On March 18, 2017, Defendant B entered into an apartment charter agreement with the effect that “Defendant B leases the instant real estate from the Plaintiff during the period of KRW 100,000,000, and from May 26, 2017 to May 26, 2019” (hereinafter “instant apartment charter agreement”), Defendant B voluntarily affixed the seal of the Plaintiff’s name on the back of the Plaintiff’s name as indicated in the lessor’s column.
Since May 23, 2018, Defendant B presented the instant apartment lease agreement to a public official in charge of Suwon District Court’s registry office, as seen above, and completed the registration of establishment of chonsegwon (hereinafter “instant chonsegwon”) with respect to the instant real estate as the head of Suwon District Court’s Magwon District Court’s Magwon Branch’s Magwon Branch’s 80195, May 23, 2018, as to the instant real estate, from May 23, 2018 to May 26, 2019: (a) the entire period of a residential building; (b) the entire duration of a residential building; (c) from May 26, 2017 to May 26, 2019; and (d) Defendant B’s Magwon’s Magwon’
C. Around May 31, 2018, Defendant B concluded a mortgage agreement with Defendant C regarding the right to lease on a deposit basis of the instant lease on a deposit basis with the maximum debt amount of KRW 30,000,000.
According to the above contract to establish a right to lease on a deposit basis as of May 31, 2018, the registration of establishment of a right to lease on a deposit basis as to the instant right to lease on a deposit basis as of May 31, 2018 was additionally stated in the registration of the establishment of the right to lease on a deposit basis as of May 31, 2018.
On June 21, 2018, Defendant B prepared a written contract for lease on a deposit basis with the content that “the lease on a deposit basis for the instant lease on a deposit basis shall be changed to KRW 30,000,000,” and affixed the seal of the Plaintiff’s name on the side of the Plaintiff’s name.
Defendant B is the Suwon District Court on June 22, 2018.
