The defendant's appeal is dismissed.

1. Of the facts charged in the instant case, the lower court dismissed the public prosecution as to the insult and assault, and sentenced the remainder of compulsory indecent acts and guilty of injury. As to this, only the Defendant filed an appeal against the conviction portion by the lower court, and the Prosecutor did not appeal. Accordingly, the dismissed part of the indictment became final and conclusive as it is.

Therefore, the scope of this court's judgment is limited to the conviction part of the judgment below.
