1. Of the judgment of the court of first instance, the part against the defendant in excess of the following amount ordered to be paid shall be revoked.

1. Basic facts
A. The Plaintiffs entered into an employment contract with the Defendant and worked as a street cleaners to which the Defendant belongs.
B. The Defendant’s content of the Management Regulations, etc. provides for the Management Regulations, No. 208, Oct. 12, 2007, as the Directive No. 208, 2007, “Nutrition indefinite contract workers and fixed-term workers management regulations for at least one year
Article 2 (Definition of Terms and Conditions of Wages, Terms and Conditions of Employment, etc.) (Definition of Terms and Conditions of Contract Workers in Nutrition, Terms and Conditions of Contract Workers, and Fixed-Term Workers for at least one year)
1. The term "weapon contract worker" means a civilian who is not a public official under the Local Public Officials Act, but who enters into a military labor contract with him/her and works full-time;
Article 3 (Scope of Application) (1) Except as otherwise provided for in other Acts and subordinate statutes (including Municipal Ordinances and Rules Directives), matters concerning labor, service, etc. of workers, shall be governed by the provisions of this Article.

3. Street cleaners: The working hours of human resources engaged in environmental aesthetic work, such as collection and disposal of wastes, cleaning, etc., shall be 40 hours a week, and the working hours shall be from 09:00 to 18:00, while the working hours shall be from 12:00 to 13:00;
Provided, That the working hours and business suspension hours may be separately determined according to the types of occupation and seasons.
If it is required for performing duties under Article 24 (Extended Work), the worker may be allowed to work for up to twelve hours a week with the consent of the worker concerned.
Article 28 (Legal Holidays) Every week Sundays shall be fixed as weekly holidays, and Workers’ Day ( May 1) and weekly holidays shall be paid.
Article 29 (Agreement Holidays) (1) The agreed holidays shall be holidays as prescribed in the provisions concerning public holidays of public offices.
(3) If it is required to continue to work on Saturdays and Sundays on duty, a holiday may be separately determined.
