1. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등폭행) 피고인은 2014. 12. 31. 23:30경 경북 봉화군 교촌2길 3(봉화읍)에 있는 로얄3차아파트 옆 노상에서 평소 친분이 있었던 피해자 B(여, 39세)가 약속장소에 나오지 않았다는 이유로 피해자를 찾아가 화를 내며, 피고인의 소나타 차량에 싣고 다니던 위험한 물건인 나무막대기(직경 약 3cm, 길이 약 1.5m)를 꺼내 와 위 나무막대기로 피해자의 등 부위를 1회 때리고, 피해자의 머리채를 잡고 재차 위 나무막대기로 피해자의 등과 배 부위를 각 1회씩 때리고, 머리채를 잡고 끌어당겨 피해자를 피고인의 차량에 밀어 넣으며 발로 피해자의 왼쪽 팔 부위를 2회 찼다.
