A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2014. 6.경부터 양산시 C 내 놀이터에서, 그곳에서 놀고 있던 6, 7세 가량의 어린 여자아이들에게 접근하여 그네를 밀어주는 등 놀아주고, 피고인의 모 운영의 “D”에 데리고 가는 등 피해자 E(여, 7세), 피해자 F(여, 6세)의 환심을 산 후, 피해자들이 나이가 어려 성적 관념이 없고 피고인이 시키는 말을 거절하지 못한다는 점을 이용하여 피해자들에게 “재밌는 놀이”라고 지칭하며 피고인의 성기 등 신체 부위를 만지게 하기로 마음먹었다.

그 후 피고인은 2014. 7. 26. 17:09경부터 17:48경까지 사이에 위 학원 내 다락방에서, 반듯이 천장을 보고 누운 자세로 피해자들에게 “재밌는 놀이, 만지는 놀이”를 하자고 하여, 피해자 E는 피고인의 가슴 부위에 앉게 하고, 피해자 F는 피고인의 하체 부위에서 피고인의 바지와 팬티를 벗기게 한 다음, 피고인의 허벅지 위에 서로 마주보게 앉게 한 후 피해자들에게 피고인의 가슴과 배 등 상체와 성기 부위를 만지게 하였다.
