1. The Defendant’s KRW 44,119,670 as well as 5% per annum from February 1, 2019 to October 8, 2019 to the Plaintiff.

The statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Partial Dismissal of Lawsuit (hereinafter “Promotion Act”) was amended and promulgated on May 21, 2019 and enforced from June 1, 2019, and 15% per annum, which is the statutory interest rate under the previous Promotion Act, was applied during the period from May 31, 2019, but the statutory interest rate under the Promotion Act was changed to 12% per annum from June 1, 2019.

Therefore, the damages for delay calculated at the rate of 12% per annum from June 1, 2019 to the date of full payment shall be recognized, and the excess portion shall be dismissed.
