1. All of the plaintiffs' claims are dismissed.
2. The costs of the lawsuit include the part resulting from the supplementary participation.
Reasons
1. Details of the disposition;
A. The Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) is a redevelopment association established on April 2, 2007 with the consent of the establishment of an association from the owner of the land, etc. in the said project area in order to implement the housing redevelopment improvement project by setting up a project district (hereinafter referred to as the “instant project district”) one of KK of Dobong-gu Seoul Metropolitan Government as a project district, and the Plaintiffs are the land owners, etc. in the said project area and are the Intervenor’s members.
B. In 2004, the Seoul Special Metropolitan City publicly announced the Seoul Special Metropolitan City Urban and Residential Environment Rearrangement Master Plan, the content of which is to designate the project area of this case as an area to be redeveloped by the Seoul Special Metropolitan City publicly announced L.
C. On December 9, 2004, the J District Housing Redevelopment Project Promotion Committee (hereinafter “instant promotion committee”) obtained consent of 57.69% (75 persons who consent to land, etc. / 130 persons who own land, etc.) of the owners of the land, etc. in the instant project area, and received the instant approval disposition from the Defendant (hereinafter “approval disposition for the instant promotion”).
Upon receipt of the application for designation of the rearrangement zone from the committee of this case, the defendant requested the Seoul Special Metropolitan City to designate the project area of this case as the rearrangement zone on September 5, 2006, after going through procedures such as public announcement for public inspection for 14 days and hearing opinions of Dobong-gu Council, and on February 8, 2007, the Seoul Special Metropolitan City designated the rearrangement zone as the rearrangement zone.
E. On February 20, 2007, the instant promotion committee, upon notifying the owners of the land, etc. of convening the inaugural general meeting of the partnership, sent the notice of convening the general meeting and the person responsible for the general meeting by registered mail, and then finalized the articles of incorporation (a draft) of the association at the inaugural general meeting held on February 28, 200
3. Consent to establish an association and improvement projects;
