1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff owns Clux C, 432 square meters (hereinafter “instant site”) in Si/Gun/Gu.
나. 피고는 공주시 C 대 432㎡ 지상에 별지 도면 표시 1, 2, 3, 4, 1의 각 점을 차례로 연결한 선내 ㈎ 부분 지상 목조 스레트지붕 단층주택 20㎡와 별지 도면 표시 7, 8, 9, 10, 7의 각 점을 차례로 연결한 선내 ㈏ 부분 지상 목조함석지붕 단층주택 45㎡(이하 ‘이 사건 각 주택’이라고 한다)를 소유하고 있다.
C. On July 4, 2012, the Plaintiff asserted that each of the instant housing units was against the boundary of the instant site, and filed a lawsuit seeking the removal of each of the instant housing units, delivery of each of the instant housing sites, from December 29, 2011 to December 200, and payment of 200,000 won per month from the date of completion of delivery of each of the instant housing units to the date of completion of delivery of each of the instant housing units (the foregoing court 2012No2322).
On November 22, 2012, the instant litigation was concluded with the following content (hereinafter “instant conciliation”).
1. The Defendant: (a) up to December 1, 2022, up to the 1st day of the official city, the CJ 432 square meters to the Plaintiff.
(a) 20 square meters of a single-story house on the ground (A) part of the ship that connects each point of the attached Form 1, 2, 3, 4, and 1 in sequence;
(b) To remove and deliver each site on the part of the ship (B) which connects each point in the attached Form 7, 8, 9, 10, 7 with the indication of the attached Form 7, 8, 9, 10, and 45 square meters on the ground;
(However, the above area is to be surveyed at the time of removal. 2. The defendant shall pay to the plaintiff 20,000 won each year from December 1, 2012 to the time of removal and delivery of the land.
3.(a)
The Defendant shall implement the procedure for the registration of ownership transfer on November 22, 2012 with respect to the land of 14 square meters prior to D, Si, Do, Si, Do, by December 28, 2012, to the Plaintiff.
B. The Plaintiff’s KRW 5,590,000 to the Defendant by December 28, 2012.
