1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Facts of recognition;

A. On August 1, 2015, the management body (representative) of the D building located in Suwon-gu, Suwon-si C (hereinafter “instant building”) concluded a contract for occupation and use of the parking lot (hereinafter “instant occupancy and use contract”) with the Plaintiff to occupy and use four pages from among the first floor parking lots of the instant building from August 1, 2015 to July 31, 2016, with the term of contract from August 1, 2015 to July 31, 2016, with the deposit for occupation and use KRW 5,00,000, monthly occupation and use KRW 400,000.

B. Pursuant to the instant occupancy contract, the Plaintiff used four pages of the parking lot of the first floor underground of the instant building for the business of the Switzerland Director (hereinafter “the Switzerland Director”).

C. On November 17, 2016, the management body of the instant building decided to the effect that “The 4 pages of the 1st floor parking lot of the instant building are used not for the parking lot, but for the head of the Switzerland, and thus, the notification of correction was received from the Suwon City on November 7, 2016.” The management body of the instant building held a meeting of the management body on November 17, 2016 and held a resolution to the effect that “the head of the Switzerland shall suspend the operation of the Switzerland and notify the eviction to the head of the Switzerland.”

In accordance with the above resolution, the management body of the instant building notified the Plaintiff of the result of the above resolution on November 18, 2016, and the Plaintiff received the above notification on November 23, 2016, suspended the business of the Deputy Director of the Swiss Team on November 23, 2016 and retired from the parking lot.

2. The plaintiff's assertion and judgment

A. (1) The management body of the instant building (1) held a representative committee of the management body on November 17, 2016 on the ground that “4 pages of the first floor parking lot of the instant building are used not for the parking lot but for the parking lot, and thus, received the notification of correction from the head of the Switzerland.” This holding a representative committee of the management body on November 17, 2016, and suspends its operation.
