Punishment of the crime

On September 22, 2011, the Defendant purchased dump trucks, construction machinery, from the office operated by the Defendant located in the Nam-gu Incheon Metropolitan City C building 212, under the name of Dongs, and borrowed KRW 44 million from the Victim Capital Co., Ltd. through the loan brokerage store of the dump trucks located in the 666-4,000 building in the 3rd floor of Daegu-gu, Daegu-gu, to cover the purchase price of the said dump trucks. On October 17, 2011, the Defendant registered the creation of a mortgage on the said dump trucks purchased by the Defendant as collateral with the mortgagee's dump trucks with the amount of KRW 4,400,000,000,000 for the secured purpose. As such, until the repayment of the loan, the duty to keep the dump trucks trucks in accordance with the security purpose was generated.

On July 2012, the Defendant borrowed a total of KRW 5 million from June 2012 to June 7, 2012, and KRW 12 million from a person who was unable to know his/her name at a dump truck in violation of the aforementioned duties, and transferred the said dump truck as security, thereby acquiring pecuniary benefits of KRW 12 million borrowed from a person whose name is unknown, and causing damage equivalent to KRW 40 million to the victim’s loan amounting to KRW 40 million.
