Punishment of the crime

On April 25, 2013, from around 08:52 to 09:00 on the same day, the Defendant used the gaps in the Ethyle room located in Suwon-gu, Busan, in order to use the gap in which the victim F is able to take a bath, and thereby cut off the Defendant’s 109 object box at 10,000 won in cash, which is the victim’s possession, 3 million won in cash, cell phone, and market price, and 6.9% in cash, which is the victim’s possession, and 3 million won in cash, 6.9% in cash, which is the victim’s possession, and 6.9% in the market price.

1. 디지털증거 분석결과 회신, E 카운터 앞 CCTV 및 각 장소에 대한 CCTV 영상 등 [유죄판단의 이유 : 피고인이 사건 당일 목욕탕에 들어갈 때에는 자신의 가방만을 들고 들어갔는데 약 6분 후에 목욕탕을 나올 때에는 자신의 가방과 함께 검은색 비닐가방을 들고 나온 점(피고인은 그날 목욕탕에 갔다가 배가 아파 병원에 가려고 목욕탕을 나서면서 전날 자신이 사물함 앞에 두고 갔던 수건 등이 든 검은색 비닐가방을 차에 실어 두기 위해 들고 나갔다고 주장하나, E 직원 H는 전날 목욕탕 뒷정리를 할 때나 그날 아침에도 피고인의 사물함 주변에 검은 비닐가방이 방치되어 있는 것을 보지 못했고 만일 가방이 방치되어 있었다면 자신이 치워두었을 것이라고 진술하였는데, 목욕탕 탈의실이 그다지 크지 않은 규모인 반면 피고인이 들고 나간 검은색 비닐가방은 쉽게 눈에 띌 정도 크기이고, 게다가 피고인은 보통 오전에 목욕을 다녀가는데 목욕탕은 저녁까지 영업을 하는 점 등을 종합적으로 고려하면 H의 위 진술은 믿을만하다
