1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On March 11, 2015, the Defendant published the 3rd qualifying examination implementation plan for licensed administrative agents on March 11, 2015, and the content of the instant case is as follows.
1. Three technical administrative officers in charge of the minimum number of successful examinees;
3. Second examination: Civil Act, theory of administrative procedures, theory of office management, and Maritime Practice Act.
6. In cases of successful examinees in the first and second examinations, those who score at least 40 out of 100 on each subject (excluding foreign language examinations concerned in the second examination), and whose average score on all subjects is at least 60: Provided, That if successful examinees in the second examination are less than the minimum number of successful examinees, those who score at least 40 on all subjects with an average of at least 40 on all subjects shall be determined additionally in order of the highest number of successful examinees until they reach the minimum number of successful examinees, and if the number of successful examinees exceeds the minimum number of successful examinees, all such successful examinees shall be determined;
B. On October 31, 2015, the Plaintiff applied for the second test of technical administrative agents among the third qualifying examinations for administrative agents on October 31, 2015 (hereinafter “instant test”).
C. On December 23, 2015, the Defendant, among the applicants for the instant examination, decided to pass the examination (minimum obtaining point 53.66 points) by three successful applicants, and on the same day, issued a disposition of failure on the ground that the Plaintiff received an average of “51.66 points (total score 620 points)” (total score 620 points) and failed to pass the examination.

1) On December 24, 2015, the Defendant: (a) on the bulletin board of the data room/test data of the “Cnetnet administrative agent” site, the “current status of implementation of the third qualifying examination for administrative agent on December 24, 2015” (hereinafter “instant data”).
(2) On December 27, 2015 and December 30, 2015, the Plaintiff posted a notice, stating that “69.77 points and the lowest obtaining point 42.00 points” as the current status of the final and conclusive obtaining of the instant test. (2) The Plaintiff’s average score is higher than the lowest obtaining point indicated in the instant data.
