A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On November 6, 2009, the Defendant was issued a summary order of KRW 1,00,000 as a crime of violating the Road Traffic Act in the support of the Daejeon District Court Seosan, which was sentenced to a fine of KRW 1,00,000, and on October 30, 2012, the same court was sentenced to a suspended sentence of KRW 2 years on August, 201 and became final and conclusive on November 7, 200.

[Criminal facts] The Defendant is a person who is engaged in driving Category C-II cargo vehicles.

On December 24, 2017, the Defendant driven the foregoing cargo vehicle under the influence of alcohol content of 0.067% during blood transfusions on December 24, 2017, and had the front of the road D at E E, which is direct from the right side to the LH apartment.

Since there is a place where traffic control is not supported, a person engaged in driving service has a duty of care to confirm whether there are cross-vehicles by reducing speed or temporarily stopping and to drive the vehicle.

Nevertheless, under the influence of alcohol, the Defendant neglected to do so and was negligent, and the front part of the Defendant’s G G-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Wn-Won

Ultimately, the Defendant suffered, by the above occupational negligence, the injury to the victim F, such as salt, tensions, and so on influenites that require approximately two-day medical treatment to the victim F, the injury to the fluor victim H of the said victim’s car, such as light fluoral salt, which requires approximately two-day medical treatment to the victim I of the passenger in the same car, and the injury to the fluor’s fluoral base, which requires approximately three-day medical treatment to the victim J for the same passenger in the same car; and the injury to the fluor’s fluoral base that requires approximately two-day medical treatment to the victim K of the same car, respectively.
