A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant was the representative director of C (hereinafter referred to as “C”) who is engaged in the business of manufacturing, selling, executing, etc. of internal cargo.

1. Around December 13, 2013, the Defendant: (a) purchased a Do (previous Vehicle Number: E) vehicle in the name of a middle and high-speed shop from which it is impossible to identify the trade name located in the north-gu death movement at a port; (b) the Defendant entered into a loan contract with the Defendant, through F of the Loan Brokerage Business Co., Ltd., Ltd., by stating, “The Defendant will offer 50,000,000 won of vehicle purchase fund as collateral and redeem the principal and interest between KRW 1,81,187 per month and KRW 36 months each month to the Defendant.”

However, the fact is that C operated by the defendant had no intention or ability to pay a monthly installment even if the defendant purchases the vehicle as above, because the enemy accumulated and the total amount of the debt reaches three billion won.

The Defendant borrowed a vehicle purchase fund of KRW 50,000,000 from the said victim on the same day, and acquired pecuniary benefits equivalent to the same amount.

2. On December 31, 2013, the Defendant entered into a loan agreement with the victim Aju Capital Co., Ltd. on the following content: (a) purchased one vehicle for the passenger vehicle in the name of the Daegu-si, Daegu-gu, Daegu-gu, 129, and (b) purchased one vehicle for the passenger vehicle in the name of C in the Daegu-gu, Daegu-gu, Daegu-gu, 129; and (c) concluded a loan agreement with the victim Aju Capital Co., Ltd. on the said content: (a) providing a vehicle as security for the loan of KRW 52,00,000 for each month and repaying the principal and interest of KRW 1,07,989 for each month.

However, the defendant had no intention or ability to pay a monthly installment even if he purchases a vehicle for the same reason as the above in paragraph (1).

The defendant is the same as the above accused victim.
