Reasons
Punishment of the crime
[2018 Highest 5524] The Defendant became aware of D from D who operates a golf driving range in Busan Young-gu B.
Around April 3, 2018, the Defendant prepared a false complaint at the office of the former EF attorney-at-law, stating that “D, at the marina shop operated by the Defendant on March 7, 2018, attempted to rape and inflict bodily injury upon the Defendant’s husband G, and thus punished for rape.” On the same day, the Defendant received a false complaint from the public service center of the Busan Young-do Police Station on the same day, and made a statement with the same content on the same day.
However, around 02:00 on March 7, 2018, the first floor defendant of the H apartment of the Busan Young-gu, Busan Metropolitan City, was in preparation for operation, and the above G was in the first marina shop with the defendant and caused injury, such as an alphatom fever, requiring approximately eight weeks of treatment by assaulting D, and there was no fact that the above D attempted to rape the defendant.
As a result, the defendant reported false facts to D for the purpose of having D punished criminal punishment.
