A defendant shall be punished by imprisonment for not less than one year and six months.

The evidence seized shall be confiscated from the accused.

Punishment of the crime

On November 21, 2018, the Defendant stated that “20,000 won shall be deposited in the H bank account (I) in the name of the Defendant on the same day from the victim to February 7, 2019, and received KRW 31,873,000 in total over 96 times, such as attached Table 1, from the day of the crime, from the day to February 7, 2019, by falsely stating that “Aphone6S” shall be sold on the Internet site F without any intention or ability to sell it.” The Defendant received KRW 150,000 from the victim to the H bank account (I) in the name of the Defendant on the same day.”

On January 28, 2018, the Defendant posted a false statement to the effect that “The Defendant would sell LG Nowon-gu’s North Korea by accessing the Internet site “L” at Gangnam-gu Seoul Gangnam-gu JPublic Notice Hostel K, and that “the Defendant would send the money to the victim M who reported and contacted the above article as the first place of dispatch.”

However, in fact, the Defendant did not possess the above LG Nowon-North Korea, and was planned to use the price for goods as living expenses, etc. from the victim, so even if he received the price for goods from the victim, he did not have the intention or ability to deliver the goods.

As above, the Defendant, by deceiving the victim, received KRW 330,00 from the victim to the N account (Account NumberO) in the name of the Defendant on the same day, and acquired it as the price for goods, and acquired it by defrauding KRW 6,378,50 in total over 18 times from around that time to February 20, 2019, as shown in the attached crime list 2.
