The prosecution against the defendant is dismissed.

On July 16, 2014, the Defendant, at around 15:10 on July 16, 2014, committed assault against the victim E (ma, 21 years of age) who was driving a taxi on the front of the “D” road located in the Gunsan City C, and caused a dispute arising from the change of the lane with the victim E (ma, 21 years of age) who was driving a taxi, and the head of the vehicle, and committed assault against the victim.

Judgment

The facts charged of this case are crimes falling under Article 260 (1) of the Criminal Act and cannot be prosecuted against the victim's express intent under Article 260 (3) of the Criminal Act. Since the victim has withdrawn his/her wish to punish the defendant after the prosecution of this case, the prosecution of this case is dismissed pursuant to Article 327 (6) of the Criminal Procedure Act.
