The prosecutor's appeal is dismissed.
Reasons
1. The judgment of the court below which acquitted the public prosecutor of the facts charged of this case on the basis of the summary of the grounds for appeal (misunderstanding of facts) and the evidence submitted by the public prosecutor is erroneous.
2. Examining the lower court’s reasoning closely with the record of the instant case, the lower court’s determination is sufficiently acceptable, and thus, the Prosecutor’s assertion of mistake regarding this is without merit.
3. The appeal by the prosecutor of the conclusion is dismissed on the ground of appeal.
