Reasons
Punishment of the crime
1. Defendant A and Defendant B’s co-offenders co-defendants are the same rent-related relationship in which they worked at the LG Plus Q.
Defendant
A, after withdrawing the above LG Pplus Q from June 1, 2014 to December 24, 2014, has been engaged in overall affairs, such as sales and inventory management of the cell phone of the above store, human resources management, computer processing, etc.
On June 2014, the Defendants: (a) laid off a new mobile phone-type terminal that Defendant A had been on duty at the above LGpller T store; and (b) Defendant B received the above mobile phone-type terminal from Defendant A to set up money to use it for entertainment expenses, etc. by disposing of it to other stores.
Defendant
A around July 4, 2014, around 2014, at the above LGplus T store, arbitrarily taken 9,570,000 Won Samsung Tamno310, which was in custody for the victim, and the defendant B disposed of 310 Samsung Tamno 310,000 won to the defendant B, and the defendant B disposed of 310,00 won to the above Samsung Tamno Tamno 310 won to the defendant C who operated "V" in Ulsan-gu U on the same day.
In addition, from around that time to December 24, 2014, the Defendants arbitrarily disposed of 259 mobile phone terminals equivalent to 241,814,100 won in total of the market price owned by the victim, as shown in the attached Table 1 by the aforementioned method, and consumed the price for personal purposes, such as entertainment expenses.
Accordingly, the Defendants conspired and embezzled the victim's property.
2. From “V” of the Defendant’s operation in Ulsan-gu U around July 4, 2014 to “V,” the Defendant purchased the stolen goods in KRW 4,00,00,00 from “V” to “V,” with the victim S that he arbitrarily embezzled, as seen above, KRW 9,570,00,000, which is the market price of the victim S that he arbitrarily embezzled, and acquired the stolen goods from that time to December 24, 2014.
